Okay now this is a heads up:
What happens when the sheriff comes because he has a copy or is investigating you because you wrote a draft?
First: You are glad--- why? because you want them to find out who the principal is. (prince of peace)
How? Usually they call and tell you they want to talk to you about a check. You tell them "Thank you very much. "please
bring all the paper work with you". You don't want them to be biased and be doing a partial investigation so when they get
there you will want to know if they have all the paperwork with them. (Usually what happens is they will only have the draft
with the offer (attachment) removed. You want to make sure the sheriff see that your "business plan" (draft) has the offer
attached to make the draft complete and the purpose of the business plan is in acceptance to their offer--- of which they
apparently didn't provide you a check with their offer so you provided a business plan (draft). Now if they are investigating
it is only fair that you request they provide you with the offering company, the one you wrote the draft to, provide you the
1099 OID and 1099 INT, so you can figure out who is the fiduciary debtor and who is the fiduciary creditor so you can
properly operate your life.
If they do not bring the paperwork with them...the offer usually, because you may have to request through the sheriffs the
copy of the 1099 OID and 1099 INT. you really have nothing to talk about. Always be polite but get some good questions
ready... he who has questions is the one who is in control. Be conversational... not interrogative!
This is not a bad move this is a good one if you handle it without feeling like the "defendant".
