  Transcript of Conversation with Roger Elvick - October 25, 2001

** Hi, It’s B* and R*j and we just wanted to share something that happened today with R*j if you have a minute.  It’s kind of funny!

R: Oh sure… go ahead

*** Here’s what happened today.   They had another court date and he (R* the dad) was in court to determine whether the court would do a psychiatric evaluation or not.  So what I had done the previous day was paperwork acceptance that we had retrieved from the trash.  I accepted everything and mailed it back to them.  Then the next thing, we had done all the searches and we put all the searches in the envelope (the oversized with blue print - Registered Draft) that we talked about last time and made it payable through Bill Jones, the Secretary of State and one of the gals in our group went down and gave it to them in the court room.

** They switched courtrooms as well as public defenders.

*** Yeah they moved courtrooms and they moved judges and they did a whole lot of other things like that.  So she had left after serving it and than today at about 5:00 pm a supervisor investigator for the county stopped by and he said his title was he controls the security of the public officials kind a thing.  He was assuming it was a threat of stalking that we are charging the court with the way they are getting their paperwork.

R: Of course … (chuckles)

*** So he started to say that these things had to stop and I said, “I’m peaceful and I request my remedy in harmony and in peace.” He said, “Oh your remedy is not to come to court anymore”. I just let it be.  He said, “ and we have your paperwork too.”  Which I say the paperwork that he had and it was the paperwork that we had gave them this morning.  He said, “I don’t understand what this is.”  So I said, “Read it to me, what does it say?”  He glanced at it for a second and then he moved on to another question.

R: Of course…

*** and he said, “What it sure looks like, it sure looks like you’re stalking, and our public officials are getting real scared and this has to stop.”  I said, “Please provide me the remedy”. And he said, “Well your remedy is not to come to court anymore!”  So I left it with that.  Than he said, “Well it looks like your getting the letters into the jail so that your Dad can sign them.”  And a lot of the questions I was being kind of general and I was just kind of going “Okay!” “Okay!” agreeing with him.  He was saying statements and I was saying … “okay” … “okay” not saying yea or nay just acknowledging.  So then he said--- well before that he had stopped by several days ago and left a couple of business cards and a note with my brother so I called him back and left a message that I was returning his call.  So what he did was he wrote a letter saying that he didn’t get my full phone number so now that I had this little piece of paper he left me I wrote an acceptance.  I said.  Thank you, your offer is accepted and returned.  Please provide the remedy and the product of your offer and signed it and mailed it back to him.
So then he said, “Well you gave me my business cards back and if I give you another business card are you going to return it to me”.  I just stood mute and I didn’t want to answer, “Yeah I’m going to return it.”  But he pulled it out of his pocket and handed it to me and as soon as I got it I moved forward with my arms to put it in his lapel pocket and he withdrew himself.

R: Yep… just drop it.

*** Yeah that’s what happened… it just fell to the ground and he got really agitated and frustrated and he said, “You back up against the wall because I’m going to pick it up right now.”  So I moved up against the wall to let him know that I wasn’t going to attack him.  So he took the business card and then left.

** You forgot to tell him about the four police officers assisting him.

*** Oh and also there were four officers standing outside their cars on the street too.  What was really interesting was when he gave me the business card I put it back to him and he jumped away like it was something much more than a business card.

R: That was the last straw that he had planned…

*** I have a question about in these circumstances, what I did was I talked very general.  Like he said statements and I just said “okay”… “okay” … just general and I’m not sure how to address their questions….

R: You don’t.  Just give them a blank stare.

** Perfect.

*** Alright

R: To be safe.  You’re probably okay with what you did.  Because he didn’t know where and how to handle it cause you kept shoving it back on him.  And if he had four other officers there he would of used them if he thought he could of got in a position to do it.

*** Yeah I was very polite about giving it back.  I didn’t hold a fist to him or anything like that.  R: You just pick it up and hand it to him and even if he doesn’t touch it just drop it and walk away.  It’s returned to him.  That’s all you need to do is just show it’s given back to him and if he refused it and let it drop to the ground than that’s a refusal.

** And where he picked it up… and tell him also about C* served it this morning… somebody totally unexpected.

*** The gal that served it today in the courtroom has the same first name as my Mom.  So what’s funny is they are thinking that the person that served it was my Mom.  So he said to tell my Mom, like you and his wife to stay out of the court and I said.  “Well please… I said something like please read the paperwork.”  And he says, “I don’t understand the paperwork.  And I said something like I request the remedy.  Then he said, … “Well your remedy is to stay out of the court.”

R: Well you could ask him… “Are you making a claim?”  chuckles…   Oh and “Where’s your check?”   more chuckles…

*** Oh!  Okay

R: “I didn’t find your check here in your offer.”

*** Oh okay

R: Here’s the thing… You don’t have to get in an oral exchange.  Just stand mute on them and when ever they hand you something, just take it and hand it right back to them.  See because that’s what they can’t handle.  We accept it and return.   Don’t refuse it.  See that’s what they’re expecting.  But he’d like to run like hell.  He’d like to give it to you and run.  You just make sure you snap it back to him real quick.

*** Okay

R: Make sure you accept it.

** They tried to give it back to C* this morning also but she got out the courtroom before they knew what was going on.

*** So what they’ve decided to do.  The next step that is going on with my dad is they decided.  Well during the whole beginning of the day where the public defender is sitting in the tank with him trying to get him, begging with him to capitulate.  He just set there and they’re telling him, “Oh it’s a one year thing and please do this…this… and this and we can get you released on your own recognizance.  You know you don’t deserve to be here.  So he still just sat there, so when the court thing came up… the next course of action.  They said, “Well we’ll take him off calendar and we’ll hold it over until the 3rd of December and what we’ll do is in the mean time we’ll have a psychological examination to determine whether he’s sane or not.”  Giving him all kinds of threats and he still stayed mute.  What we learned from you is that when these people try to get you in oral conversation just ask for a paper and pencil and write down. - I received you oral presentation and your offer is accepted and please provide the remedy.

R: Yeah!

*** What I was thinking cause now that the offer is down on paper he didn’t have to testify…

R: That’s right

*** He could have someone read it.  That is what I shared with him today on the phone.

R: Right… Good!

*** So he knows now to keep his mouth shut.  What was happening was he was starting to get to comfortable being in there and started talking too much.

R: Yeah….yep and they’ll use an informant in there that’s another inmate.

*** Well what they’ve done, because my Mom is very public they are trying to use her and what they are doing because they are going after the forensic thing.  They called her and inquired about the sanity with your husband and she started to explain that he does crazy stuff like or whatever, not really getting into details about the paperwork but that his thoughts are not public.  He doesn’t have the public mentality.  What they’ve begun to do is use my Mom because she’s very normal in the public eyes.  That’s where it’s at now.

R: Well, okay!   Somebody has made an offer about withdrawing the calendar.  Okay, that’s a withdrawal from the account.

*** Oh… that would be the judge that said that.

R: So now he’s the holder.  He’s now taken the assignment.

*** Interesting!

** Good you put all the Assignors, Assignees and Holders

R: Yes

*** So when they’ve taken it off calendar than it’s the judge taking it into his own personal account.

R: Oh yes.  But you see these guys here now they can’t wash their hands.  You see have you ever seen the VCR video of MacBeth and watched it?

*** No not yet!

R: You ought to take and watch that because you see MacBeth was a public official who murdered the King.  Him and his wife.  You need to watch that because that’s in a time when there’s no strawman.   It showed a part in there where they tried to wash the blood off their hands and it wouldn’t wash because their conscience kept calling it back.

*** Interesting!

** You know what we’ve also noticed is the public defender’s father or husband are related.  They have the same last name.  That’s who was scheduled to be the judge on R* case today.

*** Yeah, the public defender was related to the judge!  They had the same last name.

R: Than you might want to do is ask if they’re names are MacBeth… chuckling

*** Should I write that or is that a joke?

R: Well it’s a joke but you might find some way of shoving it at them.

*** Oh about the cleanliness about their conscience?

R: Right… them trying to wash the blood off their hands…

*** Well what I had done when giving us some information about drawing down or payable through Bill Jones, drawing down on the Secretary of State.  What I had done was drafted up a letter and the contents of the letter was based upon all the UCC searches and I said Your refusal to provide the delivery of your offer after my acknowledgement and request for the waiver and the remedy is deliberate extortion in fact.  then I said ..  You have authorized Bill Jones to be the pass through as the foreign agent.  So that was the letter we just gave them today.

R: Okay.  Well we’ll see how that goes.  Once this stuff now comes back if it does, you use the envelope draft…

** Well that’s what he used…

R: Oh okay… Is that a draw down on the Secretary of State than?

*** Yes

R: Or an Order?  What it is, it is an Order to the Secretary of State to order payment you see and it’s payable through.  So now those guys in that business organization when the Sec of State gets it and they don’t square up than the order from the Secretary of State goes to the State Dept. of Revenue for collection.

*** Oh, okay!  Than you put payable through the Dept of Revenue or Pay to the Order of Dept of Revenue?

R: No!  You just Pay to the Order of California Secretary of State and than down on the pass through is the actual name of the Secretary who it is Payable Through.  See the Sec of State is the one that’s the registered agent of foreign agents.

*** That was how I did it.  What I was thinking of was that in the light of addressing it to the Dept. of Revenue for collection.

R: You aren’t going to have to address that.  That is the Secretary of State.  That is something that is done in their private side, in their office.  The Dept. of Revenue is going to have to tax that business organization that has refused the remedy.  But I think what you need to do… You see when you’re just asking for remedy, you need to specify what your remedy is.  You can’t just ask for the remedy cause he’s just rubbing your nose in it saying your remedy is for you not to show in court.  You specify the remedy… I request and then you got to tell them what it is.

*** Oh okay

R: You tell them that you’ll take that remedy at the door of the Discharge Desk.

** Now he had already said something about the Barratry and also said something about the release.  Should he keep saying that or does that look like weakness?

R: No.  Once that is in writing you don’t say anything.

** I mean he should have to reiterate it if he has already written it in some other acceptance.

R: No just stand silent.  I wouldn’t get into any bantering at all even on your correspondence.

** It looks like the court is really backed up against the wall.

R: Yeah well you see they are going to go back and regroup and go well he talked and he does this and that… so the next time they are still going to try to banter with you and take everything you say down.   The Miranda Warning says… ANYTHING you say can and will be used against you.  But I can see right now those guys haven’t caught up to that yet, but they are going to.

*** Okay!  I’ll make sure we are going to keep our mouths shut.

R: Yep!

** Right we need to all practice that.  In case they call on anybody else that was in the courtroom.

*** Thanks for sharing that information with us.  His spirits are high and he’s looking at the long haul here.

R: Well we’ve got some people that are in or have been in a while.  Same thing is happening to them.  The climate is changing inside there.

** Oh is that the Michigan group?

R: Yep!

** Oh that’s good news.  I’ve been corresponding with them too.

R: Yeah there’s another one here local too.

** What do you think is going to happen with them passing these new terrorist laws?  Do you think they are going to start thinking we’re terrorists?

R: Naa it doesn’t make any difference… Not with us.  Those terrorist laws mean nothing because we are dealing with grace where there is no law.  The laws don’t hold any sway.  We just have to develop the method to take them with the involuntary bankruptcy and make the taking stick.
You see that’s what R*j was into with that jerk that came to visit and it looks like he did a pretty good job and now you just need to tighten it up a little bit more and make them come to time.  Now he walked away with his business card so he didn’t prevail.

** R*j also did something because they called the Mother and he also …. Tell him what you did with that.

*** What I did, when I found out they called my Mom, I drafted up a letter on a UCC search for Providing information.  Based upon how you said, when you get phone calls from people and you just write up something that I got an oral representation from this phone number… well I drafted up a little quick sentence that I received the offer and didn’t get the product and it’s accepted and that she holds my request and I drew up an little tiny explanation of the conversation with my Mom not getting into any of the details of the conversation like she said… then she said…. But that there was an offer and acceptance and that she’s still holding the product.  What I’m curious about is because I just went through an oral conversation with this guy, would it be something that you would see that would be beneficial to do in the same light….

R: Well what you want to do is tell them that this lady is your mother and you resent him making indecent sexual advances on her.  I’ll tell you want, he isn’t going to want to see that letter circulating here through his pals and one thing or another.
Disclosure***  This information was misunderstood by R because it was a woman who called the mother.  He thought it was the same man.
  You can state in your letter that you have a primary contract as opposed to a secondary …

*** How about overriding contract?

R: Yeah… you have an overriding contract and being a member of the family and your mother and father having a marriage contract and you being an issue of that… You see you are in a primary or superior position.  So his attempt to …

** Well they are trying to persuade him to go against him!

R: Right she is being stalked!  He is stalking her.

*** That’s what they accused me of doing.

R: That’s what HE’S doing.  So you accuse him of it on paper.  (laughter)  That maybe his background needs looking into because he is acting like a pedophile.

*** Tampering with the dowry?…

R: yeah

*** Okay… I can work on that.

R: And stalking here when they’re talking about stalking that’s like the night before Christmas and all through the house, not a creature was stirring, not even a mouse, the stockings were hung by the chimney with care with hopes that St. Nick would be there… anyway, the stalking is the stocks… the stock market.  That’s what they’re doing and he’s admitting that you’re stalking these people.  Well sure.  We’re putting them into the stocks.  See there is another definition for stocks too.  Public stock is when they lock people down in them for public ridicule.  The old public square where they stick your head and hands in a hold, where you head and hands are wedged in cuts on the boards.  That’s a stock.

** Okay

R: What else you could do is put his name in on a UCC 11 form or UCC 3.

** We have UCC form 11 now with the new change don’t we?

*** I think I know which one he’s talking about.

R: It’s a 3 I’m pretty sure.  Providing information.  So you put his name on it under the business organization of that court.  There is a place on there for, at least on the forms here, two debtors and one business debtor…

** I think here it says Entity and Individual.

R: Just one individual?

*** Yes.  How it is, is there is one box for Entity and one box for Individual.

R: Okay, so you put his name on there as the individual and you put the business organization on there which would be the court that he works for and then when you have to put his social security number and you don’t have that, then just put his telephone number on there.  Because they can get his social security number by calling him on the phone.  Then for the Fed’l ID#  for the business organization, you put your own social security number there.

*** Oh, okay!

R: What that means is that business organization belongs to you!  You’re the owner.  Now when we give that information to the Secretary of State that means those people work for you.  They’re identified as debtors and they are registered and now you see when you issue that envelope draft to order payment.  Than you see the way that thing is laid out it says  --Pay at Par, means that business organization and than it says… Pay to the Order of:  California Secretary of State, then Payable Through than Sec of States individual name.

** Okay!

R: Then you see down below it says “any other charges or costs are to be charged to the payors account which is the one up here on top… the Pay at Par.  So you see that’s when the Secretary of State is bound and than those guys are going to have to find some way to avoid the California Dept of Revenue because now at that point when they don’t turn over and make settlement than you see there is a tax liability for whoever the draft was made for.

** So that could be either Bill Jones that is holding it or these guys are tax fugitives.  So Bill Jones is going to have to make retribution with these guys are he’s going to be the one accountable.  R: Yes and now you see some of the correspondence that you sent that went back and forth between will go into the envelope.

*** Okay.

R: See it’s going to show where you’ve accepted and returned to them and made a request for remedy.

** So now R*j could have his own envelope in addition to what his Dad has happening.

R: Sure because he can let that guy know that these are sexual overtures.  He’s probably got a wife too and doesn’t want this information out.

*** Well thank you very much.

** Yeah, we’ll keep you posted.
